Terms of Service

1. Acceptance

These Terms of Service (the “Terms”) form a binding agreement between you and TheMarketSnap (the “Platform”, “we”, “us”). By creating an account, accessing any page on the Platform, or paying for a subscription, you agree to be bound by these Terms and by our Privacy Policy and Disclaimer. If you do not agree, do not use the Platform.

2. What the Platform Does

TheMarketSnap is a data, analytics, and information platform for the Indian stock market. We aggregate public market data (NSE, BSE, exchange filings, news media, broker APIs, etc.) and use AI to translate that raw data into clearer formats — daily portfolio summaries, per-stock movement explanations, market dashboards, the Snap.AI chat, the Portfolio AI chat, and (on paid plans) a daily WhatsApp report.

Important: TheMarketSnap is NOT registered with the Securities and Exchange Board of India (SEBI) as an Investment Advisor (IA) or Research Analyst (RA). Nothing on the Platform constitutes investment advice, research, a recommendation, a target price, or a solicitation to buy or sell securities. See the full Disclaimer.

3. Eligibility & Accounts

  • You must be at least 18 years of age and a resident of India to use the Platform.
  • You must provide accurate information at signup and keep it current.
  • You are responsible for keeping your credentials confidential and for all activity under your account.
  • One account per natural person. Sharing accounts is not permitted.
  • We may suspend or terminate accounts that breach these Terms or that engage in fraud, abuse, scraping, or unauthorised resale of Platform output.

4. Subscriptions, Pricing & Payments

  • We offer a Free plan, a Pro plan (₹149 / month, ₹399 / quarter, ₹1,499 / year) and an Elite plan (₹199 / month, ₹499 / quarter, ₹1,999 / year). All amounts are in Indian Rupees and are inclusive of applicable taxes unless stated otherwise.
  • Paid subscriptions are billed via Razorpay on a recurring basis until you cancel.
  • We do not run a separate trial. The Free plan is open-ended and the 3-day refund window on paid plans serves as a satisfaction guarantee.
  • Prices may change with notice; the price you locked in remains in effect for your current billing period.
  • You authorise Razorpay to charge your selected payment method for subscription renewals until you cancel via the Billing page.

5. Refunds & Cancellation

Refunds are available within 3 calendar days of payment, subject to a payment-gateway processing fee deduction. Cancellation prevents the next renewal but does not refund the current period after the 3-day window. See the full Refund Policy.

6. Communications & WhatsApp Delivery

  • By signing up you agree to receive transactional communications (verification, password reset, payment receipts, security notices) via email, WhatsApp, or both.
  • If you opt in to WhatsApp delivery, we will send your daily portfolio report, threshold-based swing alerts (Elite), and Snap.AI replies via WhatsApp Business / Cloud API. You can opt out anytime by replying STOP or by toggling delivery in Account Settings.
  • WhatsApp templates may include attached PDF reports, links to your dashboard, and brief text summaries of public market data — always informational, never advisory.
  • You are responsible for keeping your phone number current; we are not liable for delivery failures caused by stale numbers, network issues, or WhatsApp/Meta platform outages.

7. No Investment Advice

All data, AI-generated content, reports, and tools on the Platform are strictly for educational and informational purposes and are translations or contextualisations of public market data. They do not constitute financial advice, investment recommendations, or research reports under SEBI regulations. Trading and investment decisions are yours alone. Consult a SEBI-registered Investment Advisor before acting on anything you see on the Platform. TheMarketSnap is not liable for trading or investment losses incurred based on Platform information.

8. Acceptable Use

You agree NOT to:

  • Scrape, mirror, or republish Platform content (including AI summaries, movement explanations, Snap.AI replies, and PDF reports) without prior written consent.
  • Resell, sublicense, or grant access to the Platform to third parties.
  • Reverse-engineer, decompile, or attempt to derive source code from any client or server component.
  • Use the Platform to send spam, harass other users, or abuse the AI surfaces (Portfolio Chat, Snap.AI) with adversarial prompts intended to bypass safety rules.
  • Use the Platform in any way that violates Indian law or the laws of any jurisdiction from which you access it.

9. Intellectual Property

All content, design, code, and AI-generated outputs on the Platform are owned by TheMarketSnap or its licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Platform for your own non-commercial informational use. You may not reproduce, distribute, sell, or create derivative works from Platform output without prior written consent.

10. Limitation of Liability

To the maximum extent permitted by law, TheMarketSnap and its operators, contributors, and service providers shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages arising from your use of the Platform — including, without limitation, trading or investment losses, lost profits, lost data, or business interruption — even if we have been advised of the possibility of such damages. Our aggregate liability for any claim relating to the Platform shall not exceed the amount you paid to us in the 6 months preceding the claim.

11. Termination

We may suspend or terminate your account if you breach these Terms or engage in conduct that risks the Platform, other users, or the integrity of any third-party service we rely on (e.g., Razorpay, Meta WhatsApp Cloud API). On termination, your right to access the Platform ceases immediately and any unused subscription value outside the refund window is forfeit.

12. Changes

We may update these Terms from time to time. Material changes will be flagged on the Platform. Continued use after a change constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of India. The courts at Hyderabad, Telangana shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or your use of the Platform.
